Welcome! Enifex ("we", "our", or "us") provides services through its website and related mobile applications (collectively the "Services" or "Enifex"). Before using our Services, please read this Terms of Use carefully, along with any other policies or notices on Enifex’s website or mobile applications, and our Privacy Policy. Together, these materials contain terms, rules, and guidelines related to your use of Enifex.
This Enifex Terms of Use is written between you (referred to as "you" or "your" or "users") and Enifex. By accessing, downloading, using, or clicking on "I agree" to accept any Enifex Services, you agree that you have read, understood, and accepted all of the terms and conditions stipulated in these Terms of Use as well as our Privacy Policy at (insert Privacy Policy link). In addition, when using some features of Enifex Services, you may be subject to specific additional terms and conditions applicable to those features.
Please read the terms carefully as they govern your use of Enifex Services.
Changes to Terms of Use
In its sole discretion, Enifex maintains the right to alter or modify these Terms at any time. Any modifications shall be communicated by Enifex by putting the last revision date, thus, making users aware of this fact.
You must quit using ENIFEX Services immediately if you do not agree to any changes to these terms.
It is advised that you frequently review these terms to ensure that you are aware of the terms and conditions that govern your use of and access to financial services.
About Enifex
Enifex primarily acts as a global online marketplace for trading cryptocurrencies. You must register with Enifex, create an account, and fund it with cryptocurrencies before trading. You can also view real-time cryptocurrency prices on the platform, easily buy and sell cryptocurrencies, get notified of price changes that you follow, as well as check BTC spot.
Eligibility
To be eligible to use Enifex, you must be at least eighteen (18) years old and be able to form legally binding contracts. If you are using our Services on behalf of a legal entity, you further represent and warrant that: (a) the legal entity is duly organised and validly existing under the applicable laws of the jurisdiction of its organisation; and (b) you are duly authorised by such legal entity to act on its behalf. You can only use our Services if permitted under the laws of your jurisdiction. Please make sure that these Terms are in compliance with all laws, rules, and regulations that apply to you. By using Enifex, you represent and warrant that you meet all eligibility requirements that we outline in these Terms.
Account Security
Enifex is committed to maintaining the security of the users’ funds, and has implemented industry standard protection for Enifex Services. However, the actions of individual users may pose risks. You agree to treat your credentials (such as username and password) as confidential information and not to disclose such information to any third party. You also agree to be solely responsible for taking the necessary security measures to protect your Enifex account and personal information.
You should be solely responsible for keeping your Enifex Account and password safe, and be responsible for all the transactions under your Enifex Account. Enifex assumes no liability for any loss or consequences caused by authorised or unauthorised use of your account credentials, including but not limited to information disclosure, information release, consent or submission of various rules and agreements by clicking on the website, online agreement renewal, etc.
By creating an Enifex account, you agree that:
you will notify Enifex immediately if there is any unauthorised use of your Enifex account and password or any other violation of security rules.
you will strictly abide by all procedures of Enifex regarding security, authentication, trading, charging, and withdrawal.
Enifex Services
Upon completion of the registration and identity verification for your Enifex Account, you may use various Enifex services, including but not limited to, Crypto-to-Crypto Trading and other services released by Enifex. Moreover, Enifex has the right to:
provide, modify, or terminate any Enifex Services at its discretion; and
allow or prohibit some users’ use of any Enifex Services in accordance with relevant Enifex Platform Rules.
Enifex has the exclusive authority to determine which cryptocurrencies are listed on the platform and may add or remove digital assets from the platform at its sole discretion, from time to time. In respect of such additions, removals, or amendments, Enifex may, but is not obliged to, notify users in advance and Enifex shall have no liability to users in connection with such additions, removals or amendments.
Restriction
You agree and guarantee that you will not use the Enifex services to infringe on the rights and interests of others or to engage in illegal behaviour, and you agree to bear any and all legal liabilities if you breach such a guarantee. The above-mentioned infringements and conduct include:
(1) Using Enifex services in the name of another person without their express permission;
(2) Taking part in any illegal transaction
(3) providing gambling information or inducing another person to gamble in any way;
(4) engaging in money-laundering, cash-out, or pyramid-selling activities;
(5) engaging in any conduct that may expose the Enifex services system or data contained therein to computer viruses;
(6) using the Enifex services system to engage in any activity that may adversely affect the normal operation of the Internet or mobile computer network;
(7) maliciously interfering with and disrupting trading orders in the normal course of digital asset transactions;
(8) Using any technical or other means to disrupt the normal operation of Enifex or the use of Enifex services by any other user;
(9) maliciously slandering the Enifex's reputation through fabrication or exaggeration;
(10) any other conduct that the Enifex deems to be inappropriate.
Crypto-to-crypto Trading
Upon completion of the registration for your Enifex Account, you may conduct Crypto-to-Crypto Trading on Enifex in accordance with the provisions of these Terms and Enifex Rules.
a. Orders
Your Orders will be included in Enifex’s order book. Once the transaction is executed, your account will be updated to reflect that the Order has been fully executed and closed, or the Order has been partially executed. The Order will remain incomplete until it is fully executed or canceled. To conclude a transaction, you authorise Enifex to temporarily control the digital currencies involved in your Transaction.
b. Cancellation
For Orders initiated through Enifex Services, you may only cancel them before they have been matched with other users’ Orders. Once your order has been matched with another user’s Order, you may not change, revoke, or cancel Enifex’s authorization to complete the Order. For any partially matched Order, you may cancel the unmatched part of the Order unless such portion has been matched. Enifex reserves the right to reject any cancellation request related to the Order you have submitted. If your account does not have a sufficient number of cryptocurrencies to execute an Order, Enifex may cancel the entire Order, or execute part of the Order with the number of cryptocurrencies you have in your account (in each case, any Transaction related fees payable to Enifex are deducted.). In case of technical requirements and necessities, for example to deploy new versions, Enifex is allowed to cancel all open orders and will inform users before that.
c. Fees
You agree to pay Enifex the fees. Enifex may, at its discretion, update the fees at any time. Any updated fees will apply to any sales or other transactions that occur following the effective date of the updated fees. You authorise Enifex to deduct from your account any applicable fees that you owe under these Terms.
Risk Warnings
You acknowledge and agree that no transaction conducted through Enifex is free of the following risks, and Enifex cannot and does not accept responsibility for these risks:
(1) macroeconomic risks: you may suffer losses due to abnormal price fluctuations arising from changes in the macroeconomic situation;
(2) policy risks: changes in relevant laws, regulations, policies, and rules may result in abnormal fluctuations in prices and other areas, resulting in losses.
(3) default risks: You may incur losses as a result of the project owner's inability or unwillingness to carry out or continue carrying out their project.
(4) risks related to earnings: digital assets are not issued by any financial institution or Enifex, and the digital asset market is a brand new and unconfirmed market that may not generate an actual increase in earnings;
(5) trading risks: digital assets are primarily used by speculators and are used in retail and commercial markets to a lesser extent; trading of digital assets involves an extremely high level of risk because trading of digital assets occurs continuously throughout the day with no limits on the ups and downs, and thus prices are subject to large fluctuations caused by traders and/or global government policies;
(6) risks caused by force majeure factors;
(7) user's fault: any and all losses caused by the users’ fault, including losses caused by wrong decision-making, improper operation, forgetting or revealing passwords, deciphering of passwords by others, third-party intrusion into computer systems used by the users, and malicious or improper operation by a third party entrusted by the users to serve as their agent.
Termination of Agreement
If Enifex cancels the account of a user, these Terms will be terminated as of the date when Enifex approves the user’s application for account cancellation.
If a user is declared dead, the successor shall bear all of that user's rights and obligations under these terms. If a user loses all or part of his/her capacity for civil rights or civil conduct, Enifex or its authorised subject has the right to dispose of the funds related to the user's account in accordance with valid legal documents (including effective court judgments, inter alia) or instructions from the legal guardian of such user. If the successor or legal guardian of the user decides to continue performing these Terms, this shall remain valid; otherwise, the successor or legal guardian of the user shall apply to Enifex for cancellation of the account number, and these Terms shall be terminated from the date when Enifex approves the cancellation of the account of the user.
Following the termination of these terms, the users shall have no right to require Enifex to continue providing any services or performing any other obligations to them, including, but not limited to, requiring Enifex to retain or disclose to the user any information in their former accounts or to forward to the users or any third party any information that they have not read or sent.
The termination of these Terms does not affect the non-breaching party's claim against the breaching party that the breaching party shall be liable for breach of Terms of Service before the termination of other agreements, nor does it affect the performance of the post-contractual obligations under these Terms.
Remaining Funds After Account Termination
When an Enifex account is closed or withdrawn, any remaining account balance (including charges and liabilities owed to Enifex) becomes immediately payable to Enifex. Upon payment of all outstanding charges to Enifex (if any), you will have 5 business days to withdraw all digital assets or funds from the account.
Remaining Funds After Account Termination Due to Fraud, Violation of Law, or Violation of These Terms
Enifex maintains full custody of the digital assets, funds, and user data/information which may be turned over to governmental authorities in the event of Enifex Accounts’ suspension/closure arising from fraud investigations, investigations of violations of law, or violations of these Terms.
No Financial Advice
Enifex is not your broker, intermediary, agent, or advisor and has no fiduciary relationship or obligation to you in connection with any trades or other decisions or activities affected by you using Enifex Services. Enifex's communications or information are not intended to be, and should not be construed as, investment advice, financial advice, trading advice, or any other type of advice. Unless otherwise specified in these terms, all trades are executed automatically, based on the parameters of your order instructions and in accordance with posted Trade execution procedures, and you are solely responsible for determining whether any investment, investment strategy, or related transaction is appropriate for you based on your personal investment objectives, financial circumstances, and risk tolerance, and you shall be solely responsible for any loss or damage incurred as a result of such investment, investment strategy, or related transaction.
You should consult legal or tax professionals regarding your specific situation. Enifex does not recommend that any digital asset be bought, earned, sold, or held by you. Before making the decision to buy, sell, or hold any digital asset, you should conduct your own due diligence and consult your financial advisors prior to making any investment decision. Enifex will not be held responsible for the decisions you make to buy, sell, or hold digital assets based on the information provided by Enifex.
Entire Agreement
This Terms of Service contains our entire understanding and agreement regarding the subject matter hereof, and it supersedes all prior discussions, agreements, and understandings of any kind (including, without limitation, any prior versions of this Agreement) and of any nature between us. Except as provided for above, any modification to this Agreement must be in writing and must be signed by both parties.
